NOT INCLUDED - Fees for passports and, if applicable, visas; entry/departure fees; personal gratuities; laundry and dry cleaning; excursions, wines, liquors, mineral waters and meals not mentioned in this brochure under included features; travel, emergency medical, evacuation and repatriation insurance; airport transfer costs for those not participating in AHI's FlexAir; all items of a strictly personal nature.



MOBILITY AND FITNESS TO TRAVEL - The right is retained to decline, to accept or to retain any person as a member of this trip who, in the opinion of AHI Travel is unfit for travel or whose physical or mental condition may constitute a danger to themselves or to others on the trip, subject only to the requirement that the portion of the total amount paid which corresponds to the unused services and accommodations be refunded. Passengers requiring special assistance, including without limitation those who permanently or periodically use a wheelchair, must be accompanied by someone who is fit and able to assist them, and who will be totally responsible for providing all required assistance. AHI Travel regrets that some itineraries cannot accommodate wheelchairs. You may be required to complete a medical form you advise AHI Travel of certain medical conditions, mobility issues or medications during the pre-booking process.



REQUIRED MEDICAL INFORMATION - You must provide any medical information reasonably requested by AHI and may be required to complete a medical information form (the _Medical Form_). If you have any pre-existing medical conditions which may impact your ability to travel, participate in a Tour, travel to remote areas without access to medical facilities or may adversely affect the experience of others on your Tour, you must report it to AHI, and AHI may require a form signed by a licensed and practicing physician prior to or at the time of final payment for the applicable booking. You agree to provide honest information and to disclose all relevant medical information accurately and fully. AHI reserves the right to request further information or professional medical opinions where necessary, as determined in its discretion, for your safety or the safe operation of a Tour. Pregnancy is considered a medical condition and must be disclosed to AHI at the time of booking. AHI may refuse to carry women who are over 24 weeks pregnant. AHI may refuse to carry anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged. In the event that you do not provide medical information reasonably required by AHI for any reason by the deadline indicated above, AHI reserves the right to cancel your booking and all applicable cancellation fees will apply. You are responsible for assessing whether a Tour is suitable for you. You should consult your physician to confirm your fitness for travel and participation in any planned activities. You should seek your physician´s advice on vaccinations and medical precautions. AHI does not provide medical advice. It is your responsibility to assess the risks and requirements of each aspect of the Tour based on your own unique circumstances, limitations, fitness level and medical requirements.



Travel with AHI may involve visiting remote or developing regions, where medical care may not be easily accessible and medical facilities may not meet the standards of those found in your home country. The condition of medical facilities in the countries you may visit on your Tour varies and AHI makes no representations and gives no warranties in relation to the availability or standard of medical facilities in those regions.



CONDUCT ON TOUR AND AUTHORITY OF TOUR LEADERS - Such decision-making power will also reside with the Tour Leader on each trip, who can assess your ability to participate in the Tour and can determine whether your physical or mental condition renders you unfit for travel. AHI, along with our Tour Leaders, reserve the right to remove you from a tour if you are behaving in an inappropriate manner. This includes, but is not limited to: using abusive, threatening, or offensive language towards others, uninvited physical contact, harassment, vandalism, theft, violence, possession of illegal substances/items, or any other illegal or offensive conduct.



SPECIAL REQUIREMENTS - Any special requirements must be disclosed to AHI at the time of booking. AHI will use reasonable efforts to accommodate special requirements or requests but this is not always possible given the nature of the destinations visited and availability of options outside a planned itinerary. Certain activities may be inaccessible to you if your mobility is limited in any way. All food allergies and dietary restrictions must be disclosed to AHI at the time of booking but cannot guarantee that dietary needs or restrictions can be accommodated. Any special requests or requirements do not form part of these Terms or the contract between you and AHI and AHI is not liable for any failure to accommodate or fulfill such requests.



AGE REQUIREMENTS - Anyone under the age of 18 on the date of first travel is considered to be a minor. Minors must always be accompanied by an adult. One adult may accompany up to two minors. Unless otherwise indicated in the Tour description or by AHI, the minimum age for minors travelling on any Tour is 12 years old. All bookings with a minor are subject to review and approval by AHI. If the consent of a parent, guardian or any other person is required by applicable law for any minor to travel, the accompanying adult is responsible for securing all consents, documentation and ensuring that they and the minor(s) meet all legal requirements to travel, to enter into and depart from applicable countries and regions. AHI will not be responsible for any fees, damages, or losses incurred as a result of any failure to secure necessary consents, permits, and approvals.

Each adult on a booking with a minor or minor(s) is jointly and severally responsible for the behaviour, wellbeing, supervision and monitoring of such minor(s), and jointly and severally accepts these Terms for and on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. AHI does not provide care services for minors and expressly disclaims any responsibility for chaperoning or controlling any minor(s).



PRICES, SURCHARGES, AND TAXES - AHI will not increase the price of your Tour after you have paid in full. Tours are priced and advertised inclusive of applicable taxes. From time-to-time AHI may offer reduced pricing on certain products or services. Reduced pricing applies only to new bookings. Bookings where payment of at least a deposit has been received by AHI are not entitled to reduced pricing.



VALIDITY - All dates, itineraries and prices of Tours are subject to change at any time and the current price will be quoted and confirmed at the time of booking, subject to any surcharges that may be levied in accordance with these Terms. You acknowledge that you are responsible for keeping up to date on the specific details of your Tour and any other products or services.

DETAILS REQUIRED FOR BOOKING - As a condition of booking, you must provide the information requested by AHI along with final payment. If you fail to supply information required by AHI for air tickets, permits, or other inclusions, you will also be liable for any costs, fees or losses including failure to obtain or provide that inclusion. In the event that you fail to supply information required by AHI, AHI also reserves the right to treat your booking (or the relevant component of your booking) as cancelled and levy any cancellation fees deemed reasonable by AOKHI, in its sole discretion. The information required by AHI will vary by Tour and will be communicated to you during the booking process. AHI will not be held responsible for any fees you incur as a result of errors, omissions, inaccuracies, late, misplaced or otherwise incomplete information you have provided.



TRAVEL DOCUMENTS - It is your responsibility to obtain and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. You must have a passport that is valid 6 months after the last date of travel with AHI as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the Tour, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by AHI that is a direct result of your failure to secure or be in possession of proper travel documentation.



FLEXIBILITY & UNUSED SERVICES - You acknowledge that the nature of adventure travel requires flexibility and that you will permit reasonable alterations to products, services or itineraries by AHI. The route, schedules, accommodations, activities, amenities and mode of transportation are subject to change without notice due to unforeseeable circumstances or events outside the control of AHI (including but not limited to Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events and entry or border difficulties). No reimbursements, discounts or refunds will be issued for services that are missed or unused after departure due to no fault of AHI, including your removal from a Tour because of your negligence or breach of these Terms.



CHANGES - AHI may modify your itinerary where reasonably required in its sole discretion. If AHI makes a change affecting at least one in three full days of the itinerary or which materially affects the character of a product or service in its entirety (a _Material Change_), AHI will provide notice to you as soon as reasonably possible, provided that there is sufficient time to do so before departure. Once a Tour has departed, itinerary changes may be necessary as a result of unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment or comfort. Any changes are at the discretion of AHI. AHI will not be liable for any indirect and or consequential losses associated with any changes to a booking or itinerary. You are responsible for ensuring that information provided to AHI is accurate and up-to-date. Any changes to your name on any booking are subject to AHI´s approval. Any changes to a booking depend on availability and are subject to AHI´s approval and these Terms. Cancellation of any Tour, product or service included in a booking will not be considered a change for purposes of this section and will be governed by the applicable cancellation terms.



LIABILITY - AHI and its parents, subsidiaries and their respective employees, affiliates, officers, directors, successors, representatives, and assigns shall not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. You waive any claim against AHI as well as its Third Party service providers for any such loss, damage, injury, or death. In the event that any loss, death, injury or illness is caused by the negligent acts or omissions of AHI or of the Third-Party Suppliers of any services which form part of the booking contract then AHI limits its liability, where applicable by all applicable international conventions.

Carriage of passengers and their luggage by sea is governed by the Athens Convention relating to the Carriage of Passengers and their Luggage by Sea (PAL), as amended (the Athens Convention_) which is expressly incorporated into these Terms and any liability of AHI and the Carrier (as that term is defined in the Athens Convention) for death or personal injury or for loss or damage to luggage arising out of carriage by sea will be determined solely in accordance with this Convention. The Athens Convention limits the Carrier´s liability for death or personal injury or loss or damage to luggage and makes special provision for valuables. It presumes that luggage has been delivered undamaged to the Guest unless written notice is given to AHI and/or the Carrier:

• in the case of apparent damage, before or at the time of disembarkation or redelivery; or

• in the case of damage which is not apparent or of loss, within 15 days from the date of disembarkation or redelivery or from the time when such redelivery should have taken place.

Any damage payable by AHI up to the Athens Convention limits will be reduced in proportion to any contributory negligence by you and by the maximum deductible specified in Article 8 (4) of the Athens Convention.



In so far as AHI may be liable to you in respect of claims arising out of carriage by sea, AHI is entitled to all the rights, defenses, immunities and limitations available, respectively, to the actual carrier and under the relevant Conventions, and nothing in these Terms will be deemed as a surrender thereof. To the extent that any provision in these Terms is made null and void by the Athens Convention or any legislation compulsorily applicable or is otherwise unenforceable, it shall be void to that extent but not further. AHI´s liability will not at any time exceed that of the carrier under its Conditions of Carriage and applicable or incorporated conventions or other legislation. Any liability in respect of death and personal injury and loss of and damage to luggage which AHI may incur, whether under the contract with you in accordance with these Terms or otherwise, will always be subject to the limits of liability contained in the Athens Convention for death or personal injury. Notwithstanding anything to the contrary elsewhere in these Terms, AHI will not in any circumstances be liable to you for any loss or anticipated loss of profit, loss of enjoyment, loss of revenue, loss of use, loss of contract or other opportunity nor for any other consequential or indirect loss or damage of a similar nature. For claims not involving personal injury, death or illness or which are not subject to the Conventions referred to above, any liability AHI may incur for the negligent acts or omissions of its suppliers will be limited to a maximum of the price which you paid for the applicable Tour, not including insurance premiums and administration charges. AHI will not at any time be liable for any loss of or damage to valuables of any nature. You agree that you will be precluded from making a double recovery by making the same claims and seeking recovery against AHI and its suppliers, contractors or other third parties.

CANCELLATION - You will receive a full refund for cancellations made up to 90 days prior to trip departure. Cancellations from 89 to 76 days prior to departure will be subject to a $300 per person administrative fee. The withheld administrative fee may be applied to a future AHI Travel program that will operate in the current calendar year or year following cancellation. The credit will be applied to the final billing and may not be used as part of the initial deposit. It is non-transferable and is not valid toward the purchase of an AHI Cruises independent cruise. Cancellations from 75 days to 60 days prior to departure will result in forfeiture of 25% of the entire cost of the trip per person; 59-30 days, 50% of the trip cost per person; cancellations from 29 days up to the time of departure will result in 100% forfeiture of the entire cost of the trip. TRIP CANCELLATION INSURANCE IS AVAILABLE. AN APPLICATION WILL BE SENT AFTER YOU RESERVE. All cancellations must be submitted in writing to AHI Travel.

If a Tour is cancelled by the AHI Travel before the date of departure for reasons other than Force Majeure and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from AHI Travel:
i) transfer to another date of the same tour, if available;
ii) book another tour of equal or greater value, if available (you will be responsible for paying any difference in price); or
iii) book another tour of lesser value, if available (with a refund payable to you for the difference in price); or
iv) receive a full refund for the land-only portion of the applicable tour

CANCELLATION OF TRIP OPTIONS - Purchases of optional excursions, trip extensions and additional hotel nights become fully non-refundable 45 days prior to departure. Air transportation and private transfer purchases are subject only to penalties assessed by the airlines and transfer suppliers. PLEASE NOTE - Vouchers for future travel, travel credits and transfers are subject to the Terms and Conditions, including without limitation the cancellation fee schedule, agreed upon at the time of the original reservation.

MANDATORY INSURANCE REQUIREMENTS - Emergency medical, evacuation and repatriation insurance coverage of at least $200,000 USD is mandatory on all AHI Further trips. You will be required to provide proof that sufficient coverage is in place prior to departure. AHI Travel reserves the right to cancel your booking without the required insurance coverage in place as of the initial group meeting and AHI Travel will not be liable for damages or cancellation fees.

AS A CONDITION OF ACCEPTANCE OF YOUR RESERVATION, YOU AGREE AS FOLLOWS: You have read, and you understand, these terms and conditions of your participation in an AHI Travel program. You recognize and accept any risk associated with the travel program and the conditions, including the Cancellation policy, set forth herein. You acknowledge that there are many risks and uncertainties inherent in any travel, including, but not limited to weather, flooding, high/low water levels, acts or omissions of foreign governments, terrorism, war or insurrection, theft, illness, widespread communicable disease outbreak (e.g., COVID-19, SARS, etc.) or other public health emergency event declared by local, State or Federal government order to be an epidemic, pandemic, public emergency or similar, quarantines, bites from or attacks by animals, insects, or pests, and damage to person or property due to the negligent acts or omissions of tour staff or others. In consideration of, and as part payment for, the right to participate in the travel program, you hereby agree to release, hold harmless and covenant not to sue AHI International LLC (d/b/a AHI Travel), its officers, employees, representatives or agents, the sponsoring association and its officers, employees and agents, from liability for personal injury, death, property damage or loss suffered by any person in connection with this travel program, even if caused by the negligence (but not the reckless, willful, or fraudulent conduct) of travel program staff or other related persons or entities.

BAGGAGE - Baggage restrictions vary according to the airline policy and the class of service flown. Details will be provided with your pre-departure information. Baggage allowances are subject to change by the carrier without notice. Excess baggage charges for additional or oversized/overweight pieces are expensive and not included in your trip price; plan your wardrobe accordingly. Transport of baggage and personal effects is at the owner's risk throughout the travel program.

APPLICABLE LAW - You agree that any and all legal claims, actions and proceedings against AHI Travel under, in connection with, resulting from or incident to your participation in an AHI Travel program may only be brought, tried and resolved in the applicable federal or state courts having jurisdiction in the State of Illinois. You further agree that all such claims, actions and proceedings shall be governed by and decided in accordance with the laws of the State of Illinois.

GROUND SUPPLIERS - AHI may make arrangements with accommodation providers, activity providers, airlines, cruise lines, coach companies, transfer operators, shore excursion operators, tour and local guides, and other independent parties (_Third Party Suppliers_) to provide you with some or all of the components of your booking. Third Party Suppliers may also engage the services of local operators and sub-contractors. Although AHI takes all reasonable care in selecting Third Party Suppliers, AHI is unable to control Third Party Suppliers, does not supervise Third Party Suppliers and therefore cannot be responsible for their acts or omissions. Any services provided by Third Party Suppliers are subject to the terms and conditions imposed by these Third Party Suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements that govern the provision of their services. These may limit or exclude liability of the Third Party Supplier. You acknowledge that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and AHI does not warrant that any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction. AHI is not liable and will not assume responsibility for any claims, losses, damages, costs or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from the act or omission of any party other than AHI and its employees. AHI is not liable for the acts or omissions, whether negligent or otherwise, of Third Party Suppliers or any independent contractors.



FORCE MAJEURE - AHI will not be liable in any way for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for the Tour Operator failure to commence, perform or complete any duty owed to you if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Act of God, war or war like operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather, significant risks to human health such as the outbreak of serious disease including any mutation or variation of, and the ongoing effects of, Covid-19 or SARs-COV2, or any other cause whatsoever beyond the reasonable control of the Tour Operator or the Third Party Supplier of services, whether or not foreseeable, which would make it dangerous or not viable for a Tour to commence or continue, any and all of which, individually and collectively, constitute _Force Majeure_.



IMAGES AND MARKETING - You agree that, while participating in any Tour, images, photos or videos may be taken by other participants, AHI or its representatives that may contain or feature you or your likeness. You consent to any such pictures being taken and grant a perpetual, royalty-free, worldwide, irrevocable license to AHI, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.



PRIVACY POLICY - AHI must collect your personal information to deliver the Tour and any products or services booked. AHI collects, uses and discloses only that information reasonably required to enable AHI and its Third Party Suppliers to provide the particular Tour, products and/or services that you have requested. For more information on how AHI uses your data please contact your Passenger Service Representative.



SPECIAL COVID-19 NOTICE - During the period of COVID-19 contagion, you should refrain from joining a trip if you are feeling unwell, exhibit fever or other symptoms of contagious disease, or have been in contact with a person exhibiting symptoms of contagious disease within 14 days of trip departure. Affected passengers will receive a full refund in the form of a credit applicable to a future AHI Travel program. All passengers must complete a health questionnaire and execute an Assumption of Risk and Waiver of Liability Relating to Coronavirus/COVID-19 prior to trip departure. If you cannot or will not complete and execute these documents, AHI reserves the right to consider your booking cancelled as of that day and assess applicable cancellation fees.



AIR TRANSPORTATION - The price of air transportation offered by AHI Travel is based on Advance Purchase Excursion fares. After tickets are issued, penalties up to 100% of the ticket price may be levied. If connecting flights are requested, special promotional fares may be used, in which case penalties of as much as 100% may be assessed by the airlines if reservations are changed or canceled after ticketing. After departure, if the reservations are changed, you will be charged the higher, all year Economy class fare. VARIATIONS TO THE GROUP ITINERARY MUST BE REQUESTED NO LATER THAN 60 DAYS PRIOR TO DEPARTURE. Passengers who choose to make their own airline reservations independently will be wholly responsible for arrival and departure transfers, and any airline fees or penalties incurred as a result of program cancellation and/or change in travel dates, or airline schedule(s).

PRICING - All prices quoted are in USD, per person, based on double occupancy and do not include air transportation costs (unless otherwise stated) and are subject to change without notice.

AUTHORITY TO USE IMAGES AND AUDIO RECORDINGS-On occasion, AHI Travel obtains, from its staff, or from trip participants, photographic or video images of passengers and trip activities. By participating in this travel program, you authorize AHI Travel, without providing compensation to you, or obtaining additional approvals from you, to include photographic and video recordings of you, as well as voice recordings included with any videos, in AHI Travel's sales, marketing, advertising, publicity and/or training activities.

RESPONSIBILITY-AHI Travel does not own or operate any entity which provides goods or services for this program, and acts only as the agent for the independent suppliers of travel conveyance, transport, accommodations or other services. All such persons or entities are independent contractors. As a result, AHI Travel is not liable for any negligence or willful act of any such person or entity or any third person. In addition and without limitation, AHI Travel is not responsible for any delays, delayed departure or arrival, missed carrier connections, loss, death, damage or injury to person or property or accident, mechanical defect, failure or negligence of any nature howsoever caused in connection with any accommodations, transportation or other services or for any substitution of hotels or of common carrier equipment, with or without notice, or for any additional expenses occasioned thereby. Dates, Program Details and Tour costs, although given in good faith and based on tariffs, exchange rates and other information current at the time of printing, are subject to change at or before the time of departure. No revisions of the printed itinerary or its included features are anticipated; however, the right is reserved to make any changes, with or without notice, that might become necessary, with the mutual understanding that any additional expenses will be paid by the individual passenger. In no event shall any party to this contract be liable for incidental or consequential damages. In the event of an act of God, war (whether declared or undeclared), terrorism, accident, natural disaster, outbreak of disease, or other event or circumstance beyond its control that results in the cancellation of all or a portion of a travel program, AHI Travel reserves the right to issue a credit to the passenger in lieu of a money-back refund, applicable to a future AHI Travel program. Baggage and personal effects are the sole responsibility of the owners at all times. By forwarding the deposit, the passenger certifies that he/she has no physical, mental or other condition of disability that would create a hazard for himself/herself or other passengers and accepts the terms of this contract set out herein and in more specific pre-departure passenger information. The airlines and other transportation companies concerned are not to be held responsible for any act, omission, or event, during the time passengers are not on board their conveyances. The passage contract in use, when issued, shall constitute the sole contract between the company(ies) and the passenger and/or purchaser of this trip.
